Terms and conditions for home seekers

This translation is for convenience; the Dutch version is legally binding.
These terms apply when you use HuurPulse to look for a rental home. We've written them as clearly as we can. Please read them carefully before you create an account.
1. Who are we?
HuurPulse is a trade name of InviCorp B.V., located at Stationsweg 41, 3331 LR Zwijndrecht. We are registered in the Trade Register of the Netherlands Chamber of Commerce (KvK) under number 96868864. Our VAT number is NL867805286B01.

2. Definitions
- HuurPulse, we, us: InviCorp B.V., trading under the name HuurPulse.
- You: the home seeker who uses HuurPulse, with or without an account.
- Account: your personal area, My HuurPulse.
- Landlord: the owner, manager or letting agent offering a home for rent.
- Advertiser: a landlord or letting agent who posts homes on HuurPulse themselves or supplies them via an integration.
- Own listing: a home that an advertiser or partner offers on HuurPulse themselves, directly or via an integration.
- Signal: homes we spot on other websites. For these we only show basic details and a link to the original listing.
- Subscription: a paid subscription to HuurPulse, see the subscription terms.
3. When do these terms apply?
These terms apply to all use of HuurPulse by home seekers. You accept them when you create an account. If you have a subscription, the subscription terms also apply. If the subscription terms say something different from these terms, the subscription terms take precedence. How we handle your data is explained in the privacy statement.
4. What does HuurPulse do?
HuurPulse helps you find a rental home faster. This is how we do it:
- We bring together rental listings from different sources: advertisers who post directly with us, partners who supply their listings via an integration, and public listings on other websites (Signal).
- We regularly check whether homes are still available.
- You can save searches and get a home alert when a matching home comes in.
- You can save favourites, compare homes and reply directly to homes from advertisers.
Every home shows which source the information comes from. For Signal homes you respond on the original website, not via HuurPulse.
5. What doesn't HuurPulse do?
- HuurPulse is not a landlord and not a letting agent. We don't act as an intermediary in renting and we're not a party to the rental agreement. You enter into that directly with the landlord.
- We never ask for money for a viewing or for entering into a rental agreement. We don't collect rent or deposits.
- We don't guarantee that you'll find a home through HuurPulse, that a home is still available or that all the details in a listing are correct. The landlord is responsible for their listing. Please also read the disclaimer.
6. Your account
- You must be 16 or older to create an account. You confirm this by ticking a required box ("I am 16 or older"), including when you sign up with Google. We store the date on which you confirmed this.
- You must be 18 or older for a paid subscription. You confirm this when you take out the subscription.
- You fill in your details honestly and completely and keep them up to date.
- Your account is personal. You don't share your password with anyone. If you notice that someone else is using your account, change your password straight away and let us know.
- You can secure your account with two-step verification. We recommend doing so.
- You can always delete your account in My HuurPulse, under Privacy.
7. Free use and subscriptions
Searching on HuurPulse and creating an account are free. For own listings:
- Everyone can see for free: the town and neighbourhood, the rent, the type of home, the number of rooms and bedrooms, the floor area, the date from which the home is available, the date it was listed, the first photo and roughly the first half of the description. In that part of the description we leave out email addresses, phone numbers and links.
- Only with an active subscription: the other photos, the full description, the exact address, the other features of the home, the contact details, the link to the landlord's or letting agent's own listing, and replying via HuurPulse.
- The map never shows the exact location of a home, not even if you have a subscription.
For Signal homes, everyone can see the basic details and the link to the original listing.
You'll see in advance exactly what a subscription costs, what you get for it and when the next payment is due. You only take out a subscription once you confirm it yourself. Subscriptions are subject to the subscription terms, the cancellation policy and your right of withdrawal.
In short: you pay for a subscription in advance. If you cancel within 14 days of your order, you get everything back; after that you don't get money back, but you keep access until the end of the period you've paid for. If a payment fails or you reverse a payment, we pause your subscription until the amount has been paid; a reversed payment (chargeback) is not a cancellation.
8. Replying to a home
- If you reply to a home via HuurPulse, we send your name, email address, phone number (if you fill it in) and your message to the landlord. We only include your candidate profile if you tick the box for it.
- From that moment on, the landlord is responsible for your data and for their reply.
- You only reply if you're genuinely interested in the home. You don't send advertising, chain messages or messages on behalf of someone else.
- A reply is not an application that the landlord has to accept. The landlord decides who they continue with, within the rules of the law (for example the Dutch Good Landlordship Act, Wet goed verhuurderschap).
9. Rules of use
You use HuurPulse in a normal and honest way. For example, you may not:
- use HuurPulse to defraud, harass or discriminate against anyone;
- read the site automatically (scraping), overload it or try to get around its security;
- collect or use other people's data without their permission;
- make false reports.
More rules are set out in our content policy. If you don't follow these rules, we may warn you, block parts of your account or close your account (temporarily). In doing so we take into account how serious it is. Unless the law or an investigation doesn't allow it, we'll tell you why.
10. Renting safely
Scammers sometimes pose as landlords. So never pay any money before you've viewed the home and signed a rental contract. HuurPulse never asks you for payments via WhatsApp. Read our tips on the renting safely page. If you see anything suspicious, report it using the "Report an error" button or via meldingen@huurpulse.nl.
11. Availability of HuurPulse
We do our best to keep HuurPulse working well at all times. Sometimes the site is briefly unavailable, for example because of maintenance or a fault. We may change and improve HuurPulse. If we remove an important feature you're paying for, we'll let you know in advance and you may cancel your subscription free of charge.
12. Liability
- HuurPulse is not liable for the content of listings, for what a landlord does or doesn't do, or for the rental agreement you enter into with a landlord.
- If we cause damage through an error in our service, we're liable for your direct damage, up to a maximum of: the amount you paid us in the 12 months before the damage, with a minimum of € 100.
- This limitation doesn't apply if the damage is caused by intent or deliberate recklessness on the part of HuurPulse or its management.
- We never limit the rights that you always have as a consumer under the law (mandatory law).
- Report any damage as soon as possible, preferably within two months of discovering it, via support@huurpulse.nl.
13. Intellectual property
The website, the software, the HuurPulse brand and our own texts belong to us. Listings and photos belong to the advertiser or the original source. You may use the content of HuurPulse to look for a home for yourself. You may not copy or reuse that content for other purposes. Read more under copyright and image rights.
14. End of your account
- You can always delete your account. If you have an active subscription, cancel it first in line with the cancellation policy.
- We may close your account if you seriously or repeatedly breach these terms. If you have a paid subscription, you'll get back the amount for the period you can no longer use, unless your account is closed because of fraud or abuse.
- If we delete your account, we handle your data as described in the privacy statement.
15. Complaints
Not happy? Let us know. Choose the subject "Complaint" in My questions or on the contact page. We respond within 14 days of receipt. How this works is explained in the complaints procedure.
16. Changes to these terms
We may change these terms. The date and version number are always shown at the top. We'll let you know about important changes at least 30 days in advance, by email or in My HuurPulse. If you don't agree with a change, you can delete your account and cancel your subscription before the change takes effect. Changes that are solely to your advantage or that are required by law can take effect straight away.
17. Applicable law and disputes
These terms and the use of HuurPulse are governed by Dutch law. If we can't resolve a disagreement together, you can take the dispute to court. If you're a consumer, the court designated by law has jurisdiction. We don't agree any other court with you. If we start legal proceedings against you, we do so at the court of the place where you live. You always keep the protection that the law of the country where you live gives you as a consumer.
